For those both stubborn and soft in the head, who are willing to believe anything no matter how stupid, I present this short course in "What you Must Believe to Be a Birther".

You must believe Obama was born in Kenya. And Hawaii. And maybe even Canada.

You must believe that a US citizen woman who marries a non-citizen man cannot pass on her US citizenship despite what US law says.

You must believe that when a US citizen woman marries a non-citizen man, she loses not only her US citizenship, but her already-born children's US citizenship despite what US law says.

You must believe that a parent's actions can revoke a child's US citizenship despite what US law and multiple Supreme Court rulings say.

You must believe an Indonesian school record shows the truth about Obama's religion, citizenship, and adoption status, but doesn't show the truth about his birthplace.

You must believe a divorce record that doesn't say anything about a child's birthplace shows proof that Obama was born in Kenya.

You must believe a divorce record that doesn't say anything about an alleged adoption shows proof that Obama was adopted in Indonesia.

You must believe an edited tape that was though two translators and involved Obama's stepgrandmother that wasn't married to his grandfather until AFTER his birth, tells the truth about Obama being born in Kenya, but the part where the she and the translators insist repeatedly that he was born in Hawaii is a hacked internet forgery.

You must believe that the minority opinion in Supreme Court rulings (United States v. Wong Kim Ark) means more than the majority decision of that ruling.

You must believe that the majority opinion in Supreme Court rulings (Perkins v. ELG) that says someone is "to be a natural born citizen of the United States." doesn't really mean that person is a "natural born citizen of the United States."

You must believe that the Constitution says that to be a "Natural Born Citizen" one must either a) have both parents be a US citizen, and/or b) must have their father be a US citizen, despite the fact that nothing in the US Constitution OR US Legal code makes any such claim.

You must believe there is a three-tier system of US citizenship, despite the fact that nothing in the US Constitution OR US Legal code supports this claim.

You must believe that nameless, faceless internet "experts" that offer no proof of their training, experience, background or anything else, and show absolutely no evidence they have any idea what they're talking about, are somehow more reliable than real computer forensic experts and graphic arts professionals willing to put their names and reputations on the line.

You have to believe a non-profit agency based out of the University of Pennsylvania, and started by a (Republican) former Ambassador in the Ronald Reagan administration, is somehow a leftist front hiding things for Obama.

You have to believe a Republican Governor that campaigned for Sen. McCain, sealed Obama's records to help Obama, despite absolutely no evidence supporting this claim.

You must believe that Obama has spent millions of dollars hiding "evidence", despite the fact that most of the cases have been against state officials and state agencies instead of Obama, and the only input from any of Obama's lawyers in the few cases filed directly against him have been boilerplate "move to dismiss" motions.

You must believe that any of the cookie-cutter cases filed are going to be the "great white hope" that prevents Obama from taking office, even though there's not been a case that's gone to trial yet and a great many cases have been dismissed.

You have to believe a 9/11 "truther" conspiracy advocate attorney who has been professionally sanctioned in court before, an "internet powerhouse" who was denied admission to the bar due to psychological issues, a lawyer who moonlights as a performance artist and professional poker player, a dentist who got her law degree on-line, a DUI lawyer, a far-right attorney who has been fined in court cases due to his behaviour, a tax cheat who's been repeatedly under investigation and cited by a court for tax evasion, an unknown historian that goes by the name of members of the government for the Confederate States of America, and other legal lightweights somehow have more understanding of Constitutional law and US legal codes than the Supreme Court of the United States.

You must believe there's a huge conspiracy involving the news media, (both far-left and far-right), every branch of government, both major political parties, state officials in every single State of the Union, the Governments of Kenya, the United Kingdom, and Indonesia, Google, the Trilateral Commission, the Iluminati, Lizard People, Freemasons, and other groups and agencies, to hide the "evidence"

You have to believe the defenders of truth in the media are a NeoCon "news" outlet, the on-line portion of a Russian newspaper historically known for propaganda, and a supermarket tabloid.

You have to believe the Military will rise up and overthrow this conspiracy, despite the fact that active duty personnel donated to Obama 6:1 over McCain.

You have to believe there is this groundswell of public support of tens or hundreds of millions of people in this country demanding answers to your demands, even though the largest crowd at a rally has been well under 75 people.

You have to believe that groundswell will rise up and overthrow the government if they don't get answers, even though the majority of voters in this county voted for Obama and he has an 82% approval rating.

You have to believe a cadre of unknown and semi-known bloggers, many of which have a reputation for making stuff up, have somehow uncovered this huge conspiracy and threat to the US Constitution.

If you can believe all that and more without once questioning it or demanding proof, then congratulations, you're a Birther!! Or certifiable!! Or both!!

Oh, and if you're a PUMA Birther, you have to rabidly condemn sexism while using sexist slams and attacks against any female member of Obama's family, be it grandmother, mother, wife, or daughters.

30 December - And the latest Great White Hope, a claim that 26 states haven't reported their electoral votes.

"Currently, Obama only has received 170 electoral votes. The deadline for submitting the votes was last week. Congress will meet on January 8th. Can Congress over-ride the Delegates if they did not give Obama his minimum required of 270?

I am told this is the first time in history that many Delegates did NOT report in or submit their votes by the deadline. I have been told that Indiana ALL voted "Present" and cast zero votes. Can SCOTUS over-ride the delegates and just make Obama POTUS?

Some say that no one has a right to file a lawsuit until on or after Janaury 8th that is why SCOTUS refused Leo and Cort's cases. Some say SCOTUS planned a strategy assigning Phil Berg's case to January 9th when he does have standing. I believe that the longer SCOTUS waits the more damage will be done."

31 December - Anti-semite Andy Martin was one of the people pimping the Obama "Muslim Smear", so it's not suprising that he ends the year with "Barack Obama’s obsession with Islam"

"In all fairness, as my investigation in Hawai’i into Obama’s past progressed, I came to believe that “Barack Obama, Senior” was not BHO’s father. Rather, I now believe that Frank Marshall Davis was Obama’s biological father. Obama’s mother, Davis and Obama’s “father” had cooked up a scenario to protect the already-married Davis. CNN tried to make a big issue out of my claim that I no longer believed Obama was “born Muslim.” Well, I was wrong. Because I believed Obama about the facts of his birth, which turned out not to be facts at all.

But Obama was raised Muslim, in Indonesia, and his family registered his religion as “Islam” at one of his Jakarta schools. Those are documented facts. Obama’s own sister has admitted the family attended mosque on holidays.

Why did Obama suddenly come out of the closet and start parading his religious obsession with Islam? He thinks he can now get away with it."

Martin ends his rant with:

"In the meantime, while Little Barry Obama chills in his $9 million bunker in Hawai’i, the Israelis are blasting unarmed women and children into heaven with American taxpayer-supplied weapons. Rather than having “only one president,” right now it looks as though America doesn’t really have any president. Will we really have a president on January 20th, or is Barry Obama just all smoke and mirrors? And Islam? Little Barry Hussein Obama."

Andy Martin seems to be, oh, I dunno, an attention whore?

31 December - Dr. Orly's zampolit, Robert Stevens, posts another strawman attack on someone who dared to question the party line on their blog.

"This character purports to be astounded that one thousand dollars was spent on some public record that has been available since 1964 for twenty dollars. Actually, one thousand dollars is nothing. At this point, the legal fees spent by Obama to hide his past are probably up in the many hundreds of thousands of dollars. And the value of the volunteer labor and pro-bono legal work by those questioning Obama amounts to probably even more. There have been at least 4 major full page newspaper advertisements that have cost many tens of thousands of dollars. There have been tens of thousands of dollars of FEDEX charges and thousands upon thousands of certified mail expenses and regular postal expenses. A lot of money has been spent. Because Obama has steadily refused, for many months now, to produce a 10 dollar document."

Actually, not that much money has been spent fighting these absurd claims. None of them have gone to any sort of trial at all, and the vast majority of them are against State officials Look at Dr. Orly's two, Keyes v Bowen and Lightfoot v. Bowen. Both of them are against Debra Bowen. California's Secretary of State. It's the taxpayers of California paying for these things, not Obama.

The only ones Obama's lawyers have done any sort of defense on is Berg's cases. And even then, the lawyers used a common template for the motions to defense. But I asked an attorney about this, Tesibria at "What's Your Evidence", and she said this:

"From what I know, only a couple (at most) cases were actually responded to by Obama. In fact - the ONLY one I kNOW about is Berg. And that consisted of motion to dismiss (mostly standard/likely from a template); second motion to dismiss (repeating same; easy); motion for protective order (standard; likely from a template); and the one appellant brief (opposing emerg. motion; again, repeating prior stuff).

I did see one FreeRep. post in which someone asked for a source and got a response, essentially, "I don't need any source; all I need is knowing Obama's army of attorneys...."

In other words, they pulled it outta their beehind :)"

Even more amusingly, Zampolit Stevens goes on to say:

"Why might Obama's mother or his adopted father have written "Honolulu" as the birthplace on the Indonesian school registry? Why would an Indonesian official have written "Honolulu" as the birthplace on the Indonesian school registry? There are lots of potential reasons:

(1) It could have been a mistake or the result of a misunderstanding. After all, Obama had been living in Honolulu, or might have been, before going to Indonesia. This is not particularly clear. The school official or Leo Soetoro might have just assumed it was true. After all this was not a super important document; just a school registration.

(2) Stanley Ann Dunham registered the foreign births of her other two children in Hawaii, possibly to give them access to the rights and privileges of American citizenship or a connection with the US if they wanted it later. Why not Obama as well?

After all, Dunham expressed disdain for the US, as did her parents, but still maintained a connection with the US when it was to her advantage, such as working for US foundations. This is not uncommon among those who style themselves as "radicals and revolutionaries". They work to attack the system, while still taking advantage of what the system has to offer. Anyone familiar with William Ayers?

(3) Perhaps Dunham was "hedging her bets" a bit. After all, did she want to burn her bridges with the US, where she had been raised and her parents lived ? She had no problem with abandoning Obama at a young vulnerable age and leaving him with his grandparents to raise. This was clearly far easier to do if Obama had some connection with the US. Maybe she had thought about this in the back of her mind for a while as a possibility.

(4) Perhaps Dunham did not want to go into a big long drawn-out discussion with a school official about being married to a Kenyan student when she was underage and giving birth in a foreign land and being upset with Islamic practices in that foreign land. Particularly if that school official was Muslim, like most school officials in Indonesia probably were and probably are.

(5) Parents want to give their children every advantage. And they will often go to great extents to give them any potential advantage, including moving to foreign countries or even telling a white lie or two. Some parents will work two or three jobs to give their children advantages they did not have, like access to a college education. Some parents will turn into essentially chauffers, shuttling their children around to soccer practice, ballet, music lessons, club meetings, etc, completely abandoning any private lives they had for their children.

And US citizenship or a connection with the US is perceived to be an advantage. How else does one explain "birth tourism" even, from advanced places like Korea? Is it so hard to believe that Stanley Ann Dunham, who seemed to have a sort of disdain for US rules but still expected to be able to exploit it, would try to retain any potential advantages a connection with the US might offer for her son? After all, Dunham did it for her other two foreign-born children.

(6) Perhaps Dunham had to present some sort of birth documents to the school in Indonesia. And explain why this purportedly Indonesian citizen (who would not be allowed to attend school unless he was an Indonesian citizen, under Indonesian law at that time; recall that he did not begin school until the age of 7 and a half, which is a bit old for a purportedly brilliant student) did not look particularly Indonesian.

Is it so hard to believe that Dunham might have presented a Hawaiian Certification of Live Birth that showed that Obama was born in Honolulu, which she might have obtained easily to retain some sort of advantage for her son? She did this for her other two foreign-born children, after all. And is it that hard to believe that this document might show an incorrect birthplace for young Obama, since the attestation of only one relative was required at the time to obtain a Hawaiian COLB? Or that there was some fancy paperwork done at the Hawaiian Health Department associated with Obama's foreign birth to give him a COLB that had a Honolulu birth location? Which shows up on the long form vault copy, but not on the short form COLB?

Hawaiian law allows these birth records to be changed retroactively in a number of circumstances. And the Hawaiian law on birth records was particularly lax, clearly.

So is it too hard to imagine that Dunham might have taken advantage of this? Particularly to give an advantage to her child, when she did it for two later foreign-born children as well? Why is that so hard to believe?

(7) There are advantages to having multiple passports and associations with different jurisdictions. For example, Obama might have exploited his Indonesian connection to travel to Pakistan on an Indonesian passport. Might Dunham have wanted to develop and retain these connections with different countries for any potential advantages they offered, for herself and her children? "

Notice how Zampolit Stevens doesn't even consider the most likely answer - the Indonesian officials put "Honolulu" as the birthplace because that IS is his birthplace. No, he has to attack Stanley Ann Dunham, claim supposed anti-American attitudes and some gross conspiracy, because his mind is unable to see the logical and most realistic answer is that Honolulu, Hawaii is in fact the birthplace of Barack Obama.

And the original writer seems to dare question Zampolit Stevens:

Betcha that will get deleted - or made into another strawman attack. And "Anonymous" makes a valid point - the birthers rely on that school record to show that Obama is a Muslim, show that he was adopted by Lolo Soetoro, show that his name is "Barry Soetoro", show that he lost his US citizenship and became an Indonesian citizen. Yet when it's pointed out that the same school record shows a birthplace of Honolulu, Hawaii, they leap though hoops to try and claim that no, they really didn't mean that....

I want to repeat this because it's very important (bold face mine):

We all know how strongly the Birthers rely on that school record to show that:

1) Obama is a Muslim,
2) He was adopted by Lolo Soetoro
3) His legal name is "Barry Soetoro"
4) He lost his US citizenship and became an Indonesian citizen.

Many of Berg's arguements are based on the "evidence" in that school record.

However, that school record ALSO says his birthplace is Honolulu, Hawaii!! When it's pointed out, they leap though hoops to try and claim that no, they really didn't mean that....

It doesn't work that way. They can't cherry pick evidence in a document. Either the document is as valid as they claim, in which case it shows he was born in the United States, or it's not, in which case the "evidence" it provides is completely in error.

Logical consistency is NOT the Birther strongpoint.....

1 January - The ever-insane "Citizen Wells" starts off the year with his "Hall of Shame" man of the year for 2008

1 January - Ed Hale seems to be making tracks away from his claim about the divorce document between Barack Obama Sr. and Stanley Ann Dunham.....

"In his 7:45pm Plains Radio broadcast, this last night, Ed Hale backed down from his prior assertion of having gained even uncertain information about the Barack Sr. / Stanley Ann divorce decree containing language referring to Barack Jr. as being born in Kenya. Instead, Hale referred to an apparently tricky recollection... of an indeterminate person... referring to such a document's generally referring to the place of birth of the children of the divorced parents. That is not what I heard from Mr. Hale on the 31st.

Two people reported during the broadcast that they had contacted Hale's private investigator yesterday, who indicated he did not thoroughly read the documentation and does not know how it addresses Barack Obama Jr. — nor did he make a copy for himself. It would appear that Hale will receive a valid copy of this decree, probably Friday, 1/2. What it states will be what it states. He promises to post and report, as described below."

The writer of this, Arlen Williams, also finds time to repeat that common myth about "hundreds of thousands spent on lawyers"

"Further, it is suspect that Obama has invested what some say is approximately $1M to keep his actual, Hawaiian birth certificate undisclosed — seemingly thematic with "pleading the Fifth." At the very least, it would officially document his father and that is one wheel off his bike to the White House."

I think so far the most realistic estimate I've seen is between $3000 and $5000. After all, most of the suits have been at the state level against state officials, and it's the taxpayers of those states that get stuck with the bill.

1 January - World Nut Daily also gets into the New Year spirit, calling their whole "Natural Born Citizen" bulldada the "Most covered-up of 2008"

Philip J. Berg, a Pennsylvania Democrat, demanded that the courts verify Obama's original birth certificate and other documents proving his American citizenship. Berg's latest appeal, requesting an injunction to stop the Electoral College from selecting the 44th president, was denied. But the conference on the case is set for Jan. 9.

Former presidential candidate Alan Keyes headlines a list of claimants in a California suit that asked the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the until Obama verified his eligibility to hold office."

Newsflash - it's not that the story was spiked or hidden or any such nonsense, it's because there's NO TRUTH TO IT AT ALL. Your story couldn't get any traction because it's complete fiction from top to bottom, and no journalist worth their pay would touch it with a 10 foot pole - which may be why you only have gotten "The Globe" and the on-line version of "Pravda" to comment on it.....

But that's not surprising, since WND seems to think a "freeped" AOL poll has any validity, saying:

"An unscientific poll by America Online suggests more and more people are having second thoughts about Barack Obama's eligibility to occupy the Oval Office.

Those who raised questions about his vague history before the election largely drew scorn from the mainstream media, which cited an online image from Obama's campaign that purportedly proved his U.S. citizenship with a Hawaiian "Certification of Live Birth."

But the latest results from the America Online poll say only 41 percent of the participants now believe there is no issue to be investigated."

Lets see, Freepers, Birthers, and the like have been talking about how to run up the numbers on this *unscientific* poll for weeks now. All this shows is people willing to lie, rather than any "controversy".

2 January - Dr. Orly's Clinic for Impacted Wisdom has a new batshit insane claim. This time a rumour from NeoCon radio talk show host Michael Reagan's website.

"A retired INS agent who worked when Obama came into the United States stated he distinctly remembered Obama because of his 'slick' manners and speech. The agent says that he went back into the INS files and found the information and that Obama came into the USA on a FS-1 pas sport/visa. FS-1 is a foreign student visa clas sification, not a US citizen pas sport. So, who out there can get into the INS files and find Soreto/Obama's record of entry into the USA?"

Wow. Now they're grasping at coffee stirrers, never mind straws.

2 January - Despite claims from Spencer Connerat that his case isn't officially over, the Florida Supreme Court seems to have disagreed, as it says the case was dismissed on 19 December, and Connerat was sent a letter regarding the matter on 29 December.

"Petitioner's petition for writ of mandamus is hereby dismissed without prejudice because the petition does not set forth a clear legal right. Petitioner's Motion for Immediate Hearing is denied as moot."

2 January - "TexasDarlin" shows her PUMA chops and high regard for her fellow women and distain for sexism by posting her "Official Forecast for 2009", which starts with attacks on Michelle Obama and Donna Brazile, not to mention gems like:

The Convention will hit a bump, though, when the related discovery surfaces that Obama legally became Barry Soetoro in the 1960s when he acquired Indonesian citizenship, supporting assertions made on this blog months ago that Obama concealed his real identity during the Presidential campaign. 2 January - In the absence of the supposed Obama-Dunham divorce papers that Ed Hale didn't come up with, "Citizen Wells" repimps the Soetoro-Dunham divorce papers, claiming Yet Again that it proves Lolo Soetoro adopted Barack Obama.

"Below is a copy of the Divorce Decree between Stanley Ann Soetoro and Lolo Soetoro that became final on Nov 6 1980. The decree granted divorce and child custody. The document reveals several important details about the marriage dissolution. However, the most important revelation is that Barack Obama and his sister Maya had been legally adopted by Lolo Soetoro:

“The parties have 1 children below age 18 and 1 chidren above 18 but still dependent on the parties for education.”

This information is not mandatory to disqualify Obama from the presidency, however it is more compelling evidence that demands that Obama must step forward with proof that he is eligible."

First off, Earth to "Citizen Wells", why in the world would Lolo Soetoro NEED TO ADOPT HIS OWN DAUGHTER!!!!

Second off, Barack Obama was dependent on his mother for education expenses. She was a party in this divorce. There's nothing in the decree that proves at all that he was adopted by Lolo Soetoro, (and even if he was, it wouldn't have affected his US citizenship.

Oh, and speaking of US citizenship, notice the divorce was filed in Hawaii. If Stanley Ann Dunham lost her US citizenship like Berg et all claim, (and by extension Barack Obama), why on earth was this filed in the US rather than Indonesia. Unless, oh, she was still a US citizen and counted Hawaii as her state of residence while she was living overseas........

The more they keep digging for anything to support their idiotic theories, the more they bury themselves.....

2 January - And speaking of divorce paperwork, according to Arlen Williams, Ed Hale really has the Obama-Dunham divorce papers, no really, he does.

"As of this post, PlainsRadio.com (http://www.plainsradio.com) is to have gained a copy of the divorce decree between Barack Hussein Obama, Sr. and Stanley Ann, parents of the man who would be president. 2 December - And Berg goes "big deal" to Ed Hale and the people at Plains Radio, stating he's had the Obama-Dunham divorce papers for a while.

Less likely, but still possible, is that Google itself has "pinned" certain articles to be high ranking. Reportedly Google CEO Eric Schmidt backs Obama, has campaigned for him, and even is being considered for a position in the Obama administration. "

The "I can't be wrong so blame everyone else" mentality is classic paranoia - and conspiracy theory.

2 January - Oh, and Zampolit Stevens references this article from 2 January about getting the GOP to make more effective use of technology in his whine how Conservatives are ignoring the Birthers.

4 January - Playing ethical and moral limbo, Dr. Orly shows how low she can go, reposting a request for someone to visit Madelyn Dunham's brother and have him sign consent forms for the release of the death certificates for Madelyn Dunham and Stanley Ann Dunham.

This also goes with their fishing expedition trying to find out if Obama broke any laws spreading his grandmothers ashes at a beach. (which, honestly it looks like he might have. "Disposal location and measures - Cremated remains

Cremated remains shall be buried in or on ocean waters without regard to the depth limitations specified for non-cremated remains in paragraph 2 above provided that such burial takes place at least three nautical miles from land."

This may have been a simple "oops" on their part. In any case, it's hardly an impeachable offense, since I suspect violators get a simple citation and a fine.

Basically though, they're after some "proof" that Obama lied about his mother's and grandmother's deaths. Case in point from the comments:

I wonder what happened on that day or a day before? It looks like something happened that spooked this Adams family. What was it? I'd like to end this update with a note for this week (4-10 January)

This week sees three things happen.

On Thursday, 8 January, Congress meets in joint session to count and certify the Electoral College votes. Barring any hanky-panky, (the Birthers are hoping for a Senator and Congressperson to throw sand in the gears), this will officially certify Barack Obama as President-Elect.

Also on 8 January, James Broe of Broe v Reed is scheduled to have his case heart at the Washington State Supreme Court. Dr. Orly claims to have helped in this case. There's nothing new in this case at all, it's a mix of Berg and Donofrio. I suspect it will be dismissed by 13 January.

And on Friday, 9 January, Berg has his request for a writ of certiorari discussed in conference with the Supreme Court. Assuming this conference follows the same pattern as before, there will be no note of it in the release of the writs granted on the 9th, and confirmation will take place the following monday (12 January.)

It is now 16 days before Barack Obama is sworn in as President. Expect the Birthers to get more and more insane, and for more and more legal tricks, last minute filings, and demands for emergency stays to take place. Not to mention trying to throw everything they can against the wall and pray something sticks.

CHALLENGE (with answer), CAN ANYONE PROVE THIS WRONG?:–

1. Constitution Article II requires USA President to be “natural born citizen”.

2. BHO’s website admits his dad was Kenyan/British, not American, citizen when BHO was born.

3. BHO is therefore not a “natural born citizen” (irrespective of Hawaiian birth or whether he may be a 14th Amendment “citizen” of USA) — confirmed in the Senate’s own McCain qualification resolution (that both parents must be citizens of USA) co-authored by BHO.

5. Since the fact of BHO’s dad being Kenyan/British not in dispute, Supreme Court rules on Summary Judgment to enjoin BHO’s inauguration as President.

6. Therefore, BHO is not inaugurated as President.

7. Vice President Elect Biden is inaugurated Acting President under the 20th Amendment to serve until new President is determined — the procedure for which determination to be set out by Congress and/or the Supreme Court so long as in conformance with the Constitution.

ANSWER TO ABOVE CHALLENGE

IF, when counting the electoral votes, Congress WERE TO find by 1/8/09 that Obama — not being an Article II “natural born citizen” (father Kenyan/British, not American) — fails to qualify as President, Biden would become the full fledged President under 3 USC 19 (free to pick his own VP such as Hillary) AND THERE WOULD BE NO NEED FOR DEFERRAL TO THE SUPREME COURT to enjoin Obama’s inauguration relegating Biden to being merely Acting President under the 20th Amendment until a new President were duly determined.

(The preferable choice, at least for the Democrats, would seem obvious.)

TedBot - Here's my replies for when your "challenge" was posted as two seperate comments. Again, do *TRY* and keep up. This isn't a Birther blog where people blindly accept whatever your spew du jour is.

1. US Constitution, Article II, Section 1, Clause 5 says:

"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States."

2. At least two cases where one or both parents were not US citizens determined that a child born in the US was a natural born citizen.

Wong Kim Ark:

"It was held that a person born within the jurisdiction of the U.S. to non-citizens who "are not employed in any diplomatic or official capacity" is automatically a citizen, per the Fourteenth Amendment. "

Perkins v. ELG:

"The U.S. Supreme Court concluded that Marie Elizabeth Elg who was born in the United States of Swedish parents then naturalized in the United States, had not lost her birthright U.S. citizenship because of her removal during minority to Sweden and was entitled to all the rights and privileges of that U.S. citizenship. In this case, the U.S. Supreme Court affirmed the decree that declared Miss Elg "to be a natural born citizen of the United States."

Perkins v. ELG also references a earlier case of a Prussian subject who came to the US, had a son, and returned back to Prussia. Quote:

"'Young Steinkauler is a native-born American citizen. There is no law of the United States under which his father or any other person can deprive him of his birthright. He can return to America at the age of twenty-one, and in due time, if the people elect, he can become President of the United States"

So the citizenship of Obama's father doesn't mean anything. By US law and multiple decisions of the Supreme Court, a child born in the United States is a "Native Born" US citizen and therefore qualifies under the US Constitution, Article II, Section 1, Clause 5.

3. The 14th Amendment to the US Constitution, Section 1. says:

"Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Technically speaking, if one is born in the United States - even to two US citizen parents, then one is also a citizen under the 14th Amendment.

4. Berg's cases have not been decided. The track record for such cases is remarkably poor, and there is no reason to believe writ or injunction would be granted.

5. The "facts" in Berg's case are very much in dispute. In the unlikely event SCOTUS would grant Berg's case, all that means is it would be sent back to the lower courts to review their ruling. And there is nothing in Berg's lawsuits - any of them - that would stand cross-examination. Standard legal proceedure for a defendant is to not address issues and move to dismiss. If dismissal is granted, you ignore the issues the plantiff brought up. If dismissal is not granted, then defendant addresses the issues - and Berg's cases would be torn apart if that happened to him

6. Unlikely.

7. If for some reason Barack Obama, (you CAN write his name you know. The constant "BHO" does nothing except make you look stupider), was found to be unable to be President, then Biden, having qualified, would be sworn in as Acting President while the Congress and Senate decided to leave him as President or select a new President The Supreme Court would not be involved as the 20th Amendment doesn't call for SCOTUS to have a say in the selection. The most likely result in the unlikely event Obama couldn't serve would be Biden as President, with Pelosi or Byrd becoming VP as per the presidential line of succession, as specified by the Presidential Succession Act of 1947 (3 U.S.C. § 19) (Clinton, as Secretary of State-designate, might also be considered for the role) There is no senario where both Obama AND Biden would be disqualified, so the hope that somehow McCain / Palin would end up President / Vice President after all are slim, none, and forget it.

However, #5, 6, and 7 are meaningless because, due to birth in Hawaii, Barack Obama IS a Natural-Born US citizen according to the Constitution and US Law. And what IS US Law regarding citizens? To cite US code, Title 8, Chapter 12, Subchapter III, Part 1, § 1401:

The following shall be nationals and citizens of the United States at birth:

(a) a person born in the United States, and subject to the jurisdiction thereof;

(b) a person born in the United States to a member of an Indian, Eskimo, Aleutian, or other aboriginal tribe: Provided, That the granting of citizenship under this subsection shall not in any manner impair or otherwise affect the right of such person to tribal or other property;

(c) a person born outside of the United States and its outlying possessions of parents both of whom are citizens of the United States and one of whom has had a residence in the United States or one of its outlying possessions, prior to the birth of such person;

(d) a person born outside of the United States and its outlying possessions of parents one of whom is a citizen of the United States who has been physically present in the United States or one of its outlying possessions for a continuous period of one year prior to the birth of such person, and the other of whom is a national, but not a citizen of the United States;

(e) a person born in an outlying possession of the United States of parents one of whom is a citizen of the United States who has been physically present in the United States or one of its outlying possessions for a continuous period of one year at any time prior to the birth of such person;

(f) a person of unknown parentage found in the United States while under the age of five years, until shown, prior to his attaining the age of twenty-one years, not to have been born in the United States;

(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years: Provided, That any periods of honorable service in the Armed Forces of the United States, or periods of employment with the United States Government or with an international organization as that term is defined in section 288 of title 22 by such citizen parent, or any periods during which such citizen parent is physically present abroad as the dependent unmarried son or daughter and a member of the household of a person

(A) honorably serving with the Armed Forces of the United States, or

(B) employed by the United States Government or an international organization as defined in section 288 of title 22, may be included in order to satisfy the physical-presence requirement of this paragraph. This proviso shall be applicable to persons born on or after December 24, 1952, to the same extent as if it had become effective in its present form on that date; and

(h) a person born before noon (Eastern Standard Time) May 24, 1934, outside the limits and jurisdiction of the United States of an alien father and a mother who is a citizen of the United States who, prior to the birth of such person, had resided in the United States."

What is more likely is that the house and senate, failing to believe the myths the Birthers are pimping, will certify the electoral votes. But frankly, it's stopped being funny or entertaining to me. And I promised myself that after Jan 20th, I will NOT look at it any more. Kudos. The only thing I would add is that Orly's fishing expedition about the scattering of his grandmother's ashes is going nowhere. The EPA leaves it to the states to regulate within three nautical miles, and Hawaii has no problem with cremated remains being scattered from the shoreline or within three miles. In fact, the National Park Service even allows ashes to be scattered at most locations within Hawaii Volcanoes National Park. Of course, this info comes from Janice Okubo, spokesperson for the Hawaii Department of Health -- the same person whose words about the veracity of Obama's COLB have been endlessly parsed by the Birthers to conclude the very opposite of what Okubo stated. Thank you for the list. I'm sure its impossible to list everything as the imagination of Birthers is limitless. One I thought of is you must believe that Senate Resolution 511 states that to be natural born you must both be born in the United States and have both parents be American citizens when it clearly says that birth on US soil alone is dispositive.

I have been following this closely and have debated between concluding that Birthers are dangerous nuts and concluding that they are hapless and therefore harmless nuts. I assume its mostly the latter, though the latest from Orly's site is a blitz to try to get elderly Obama relatives to give up the truth, sign releases, etc. Again, this seems like a quixotic gesture, but it is offensive that they would even think of imposing themselves and their delusions on private citizens, particularly elderly ones.

One anonymous poster on Orly's site dared say that contacting relatives lacked common decency, but I expect the post will be deleted within hours.
