Running on Empty - Berg/COLB update
I'd like to start this update with a couple notes to the people in the Cult of the COLB and the various BergBots out there.
First off, just because there's multiple lawsuits out there doesn't make it any the more valid. There's multiple copies of "The Protocols of the Learned Elders of Zion" out there, but it doesn't make it any the less a forgery. With lawsuits, like most things, it's quality not quantity that matters. The fact that of the 15 or so cases currently out there, at least six have been dismissed. Even the ones in the Supreme Court don't look good.
As for the Supreme Court, we'll know more after 1 Dec. if Souter rejects Berg like expected. And 5 Dec. is when we find out if the SCOTUS picks up Donofrio. There's a pretty massive track record of rejection in the lower courts - not one court that has made a decision has moved to proceed. Unless you want to buy into the tinfoil hat theory they're ALL in Obama's pocket, then logically you have to wonder if there's any validity in these suits.
And another note - it's obvious that none of you have the slightest interest in President-elect Obama's citizenship, birth certificate, etc. All this REALLY is, for all your pious claims about the Constitution and the like, was keeping someone you didn't like out of the White House, and when that failed, trying to undermine and pretend his presidency is "illegitimate".
Because if you can pretend he's not really the president, then you can handle the fact he's in the White House. For whatever your professed reasons, be it annoyance over the fact that your choice (Hillary/McCain/Keyes/whoever) didn't win, or even the "In case you haven't noticed, he's black" attitude, it's obvious it's not really any of the reasons you claim. It's undermining the President, pure and simple.
At least someone was honest when they said to Neo-Confederate "Judah Benjamin" in "Natural Born Citizens: Or How to Beat a Subject to Death with a Stick.", that:
"Remember, if the public starts to believe that a president will be a one term president, then that president’s power will become weak.
So, if the public starts to believe that Obama will be a one term president, Obama will be a very weak president."
Berg, TexasDarlin, Judah Bejamin, etc., is pissed that Sen. Clinton didn't win. Others are pissed that a Democrat won, still others are pissed a "n--ger" won. And it's telling that even in the cases that they give lip service to McCain's own citizenship issues, the primary focus is on Obama. For others, the SOLE focus is on Obama and a desire to have the SCOTUS overturn the entire election and give it outright to McCain/Palin, or Sen. Clinton, or whoever, will of the people and the voters be damned.
It's either being a sore loser, or something far more ugly that drives those people.
18 November - "World Net Daily" asks at a White House Press Conference "Does the White House believe there is no question at all about the birthplace, and thus the required U.S. citizenship of the president-elect?"
The answer?
"I think we're in good shape on that," responded Dana Perino, the spokeswoman for the president."
19 November - Yet another lawsuit, this one in Texas. Case #081001C3368, filed District Court for the 368th Judicial District, Williamson County, Texas.
It's another cookie-cutter clone of Berg's lawsuit, same old tired claims.

19 November - Over at "democratic-disaster.com", "PaulM" makes this rather amusing comment:

21 November - And "TexasDarlin" claims that "it's not the birth certificate, honest!". Considering how much they pimped Polarik and TechDude, that's news to me. Looks like she's backing the citizenship thing Neo-Confederate "Judah Benjamin" started.

We think that THIS is the factual scenario being concealed by Obama, as we’ve said for months. We haven’t changed our fundamental position."
22 November - And anti-semite Andy Martin finally gets around to acknowledging that his lawsuit in Hawaii was booted. And whines that the dog ate his homework. Well, maybe not that, but something equally unconvincing.
"Unfortunately, I have not seen a copy of the decision. Despite the significance of the court order, I was not given a courtesy notice when it was entered in Honolulu, apparently late Wednesday, although I was in Honolulu all day on Wednesday."
To nobody's surprise, he's planning to appeal.
"Depending on what the response is to a fund appeal, I will certainly appeal this decision to the Hawai’i Intermediate Court of Appeals. The trial court’s interpretation of the relevant statute appears to be a wooden reading of the law. The claim that there is a lack of historical significance to the birth certificate of a president of the United States is a classic example of how utter nonsense can exist in the judicial system."
22 November - A "final report" from "Polarik", or as he's going by now, "Dr. Ron Polarik. M.S., Ph.D." I'd add FoS for Full of Shit. It's long on technical babble that his fans on Free Republic seem to like, but very little actual data. Actually looks like the same old stale rehash he pimps out anyplace he can post. And he starts by whining and playing martyr....

I suspect the only "personal costs" he suffered was repeatedly being shown he didn't know what the hell he was talking about. However if claims of dead bunnies worked for "TechDude", why should "Polarik" be any different?
22 November - and right-wing site "Right Side News" comments on what they call the "Great Birth Certificate Scandal-Cover-Up of the 2008 Election"
"Contrast these shabby examples of "journalism" with the legions of identifiable, verifiable and credible sources who for months have been investigating the disturbing allegation that Barack Obama is ineligible for the presidency because he has failed to meet one of the three requirements that the U.S. Constitution mandates, specifically that he provide proof of his "natural born" U.S. citizenship."
And are these "legions of identifiable, verifiable and credible sources" ?? Berg, Martin, Polarik, and the others who have been dribbling this smear campaign out for a while. Sources that in every case have been disproven over and over again.
It then goes on to wonder why conservative media hasn't picked up on this story, accusing Fox news of being paid by the Saudis, and lambasts Limbaugh, Levin, Ingraham, O'Reilly, and Hannity, saying:
"The very people - the so-called loyal opposition - who should have been shouting this story from the rooftops for months on end went mute. Ordinarily they would be the first to tell you that our Republic has no more precious document than the U.S. Constitution - a document that set the stage for the greatest experiment in human freedom since the beginning of recorded history. "
You know, it seems to me that if the right-wing media thought there was any truth to this claim, they would have trumpeted it ages ago.
It's a tell-tale sign of paranoia and conspiracy buffs that either you a) agree with everything they say 110%, or b) you're one of "them" and working to supress their pet theory. It's never c) there's no validity to their pet theory.
24 November - and it seems that "Faith 2 Action", fresh off of pimping the ad that Philip Berg took out, had on their 21 November radio show both Jerome Corsi AND "Dr. Ron Polarik" has he is now styling himself.
Note that there is no information on a "Dr. Ron Polarik" outside of right-wing media. He claims to have a Ph.D. in "Instructional Media", but you would think there would be some evidence outside of the right-wing blogs that showed, well, anything at all. Nothing.
24 November - AOL's "Political Machine" blog talks about the people who cannot let this fiction drop.
"Some, it seems, haven't quite made up their minds. As Forbes reports, lawsuits still abound regarding the legitimacy of Barack Obama's election. The suits specifically call for the President-elect to produce his birth certificate from the State of Hawaii. The certifcate was released electronically but met with some skepticism, and since that time, the State of Hawaii has issued an official press release stating in no uncertain terms that they have the certificate on file. Although a number of such suits persist, the chief face behind the allegations is clearly Phillip Berg, an attorney and Democrat from Philadelphia. Berg is not only filing in court, he has run advertising in major newspapers and put out youtube videos and a website, all regarding the authenticity of Obama's birth certificate and alleging that he was born in Kenya. As noted at Forbes, Berg is unmoved by debunking of the issue by sites like FactCheck.org and noted myth-busting website Snopes.com.
Berg's argument for pressing this issue is that the United States would face a constitutional crisis if the matter is unresolved by the time Obama is inaugurated. The only thing which will constitute a resolution for Berg is seeing the original birth certificate himself, something which is not permissible under Hawaiian law unless Obama himself requests the original. It does seem rather flawed logic on the part of Mr. Berg. If he is not able to produce any evidence that the President-elect wasn't born in the United States, and if it is legally agreed by all others that, indeed, Obama was born in Hawaii, it is hard to imagine from where that crisis would come."
The writer brings up a very valid point. Berg's "evidence" is flimsy at best, and the US government and the State of Hawaii all agree that President-elect Obama is a US citizen. Berg's braying about "Constitutional crisis" is meaningless because those that matter will be convinced of citizenship - and those who won't be convinced will never be convinced.
24 November - And "IlluminatiTV" posts a YouTube video with the so-called "Dr. Ron Polarik". You would think he would offer some proof of his bona fides. No, they pixelate his face and distort his voice.
Why? Because there's no way any of his opinions, (and that's what they are, because he offers no proof) are anything but an opinion. A YouTube video does not equal proof.
You REALLY believe what you're peddling "Dr. Ron Polarik"?? Then give us your real name, your education, training, and credentials. Until you do any or all of that, you're just another liar.
The video later was mysteriously "taken down by user", (no doubt to preserve the air of paranoia the cultists prefer), but other copies have spread like herpies across YouTube.

25 November - "Boing Boing" posts a link to a story asking "Were McCain Supporters 419-scammed by Nigerian "African Press International"?" over at "Hard News, Inc.".

25 November - Janet Porter of Faith2Action pimps "Dr. Ron Polarik's" latest steaming pack of lies in the pages of WorldNetDaily. (Which is funny, because WND in the past has said the COLB is REAL. They can't even keep their own lies straight......)
25 November - Out in California, the apply-named right-wing lawyer Gary Kreep announces a new strategy for the Cult of the COLB - one that's guaranteed to see him become listed as a "vexatious litigant". They're going to file lawsuits challenging every single thing President Obama does until they, quote, "get a decision as to his citizenship status"
Of course, since there is absolutely no proof they'll believe and no court ruling they'll accept, this means that they're already planning to keep this crap up though President Obama's administration.
"A lawyer who is playing a key role in a California lawsuit urging officials to prevent the state's 55 Electoral College votes from being recorded for Barack Obama until questions about his citizenship are resolved says he's organizing plans to challenge, even after the inauguration, every order, every proposal, every piece of paperwork generated by Obama.
"We will file lawsuits on his actions, every time. As long as we have money , we will keep filing lawsuits until we get a decision as to his citizenship status," Gary Kreep, chief of the United States Justice Foundation, told WND today.

25 November - and a real computer forensics specialist, Dr. Neil Krawetz, weighs in on "Dr. Ron Polarik's" video. And unsurprisingly, blows it out of the water.
"Polarik's findings are not supported by the data. He has manipulated evidence, selectively ignored facts, and overlooked obvious findings. He has made over-reaching and gross assumptions, which vary from baseless to provable inaccurate. Moreover, he claims vague credentials that are unsupported by his work. I have serious doubts about Polarik having a Ph.D., but he sure has a lot of BS."
25 November - The Wall Street Journal touches, dismissively so, on the cult of the COLB and both Berg and Donofrio's lawsuits:
"The probability that the court will actually grant certiorari is, in theory, greater than zero, but it is such a small number as to be incomprehensible to anyone within the ordinary range of intelligence. As Judge Peter Messitte notes in an article for the State Department's eJournalUSA, the justices typically grant such petitions only for cases "raising particularly significant questions of law, and/or those where there is a division of legal authority, as where lower courts have produced conflicting interpretations of constitutional or federal law."
An additional rumor, not repeated by Forbes.com's Serchuk, is that the "response" that Obama is "required" to file next week consists of proof that he is a natural-born citizen. Those who make this claim seem to believe that cert. is two, two, two writs in one. In fact, the only question currently before the high court is whether to hear the appeal at all.
Even in the vanishingly unlikely event that the court does grant certiorari, it almost certainly would consider only the legal issue raised by the lower court's ruling--namely, whether Berg has standing to sue. In the even more vanishingly unlikely event that the justices rule in his favor, the case would be returned to a trial judge for consideration of the factual allegations.
One Leo Denofrio has a pending petition for certiorari in a similar case that was dismissed by the New Jersey Supreme Court. His prospects for success are approximately equal to Berg's, for the same reasons. We devoutly hope this is the last item we will ever have to write on this silly topic."
25 November - The WSJ's James Taranto has a podcast discussing the "Obama lawsuit urban legend"
25 November - and because it's not the Cult of the COLB without some half-assed claim of death threats, comes a claim that North Carolina Congresswoman Sue Myrick uncovered a threat from a "Islam terrorist organization" against Leo Donofrio and maybe Philip Berg.

These are the reasons why I would give this any kind of credence. "

26 November - And MSNBC comments on the Berg and Donofrio lawsuits as well.
"Pennsylvania lawyer Philip Berg claims that the circumstances of Obama's birth are vague and that he may have been born in Kenya. Obama's mother, Berg asserts, later flew to Hawaii to register the birth.
Leo Donofrio, a New Jersey lawyer, contends that election officials in his state failed to ensure that only legally qualified candidates were placed on the ballot. Obama may have been born in the United States, Donofrio argues, but "natural born" status depends on both parents being American citizens. Obama's father was Kenyan.
The justices are unlikely to take up these cases for a host of reasons, not the least of which is the invitation to overturn the results of an election in which more than 66 million Americans voted for Obama. An equally high hurdle is the issue of whether Berg or Donofrio have the legal right to sue claiming a violation of the Constitution."
26 November - And to nobody's surprise, anti-semite Andy Martin appeals the Hawaiian court decision, because, wahhh, the big bad court didn't agree with him, wahhh.
"The Court managed to take what is at its core a simple and straightforward case seeking review of denial of access to a Hawai’i record, and to add layers of confusion and complexity that were totally unwarranted by the record made in open court on November 18th. For the reasons that follow, Plaintiff moves the Court to reconsider, vacate and rehear the matters decided on November 19th using the correct procedures and standards of law.
Plaintiff initially thought that he would appeal the order to the Intermediate Court of Appeals, but it would be a disservice to that Court to appeal such a mangled and needlessly confused record from the trial forum. Thus, the Rule 59 motion (see below) stays any appeal until a decision on this motion."
And he concludes by saying:
"At a certain point, the cumulatative errors in this proceeding raise an inference of harassment of an out-of-state litigant. Under the Privileges and Immunities Clause, a non-Hawai’i resident should obtain the same due process that a native or resident receives. Hawai’i is not a private club that is maintained for the benefit of insiders."
26 November - And Leo Donofrio is screaming "TREASON!", claiming that the same SCOTUS clerk that supposely caused him problems is also causing problems in the appeal of WROTNOWSKI V. CONNECTICUT SECRETARY OF STATE.
"Mr. Wrotnowski has been through two lower courts and is now using our US Supreme Court rules to properly petition our Supreme Court for relief. This is outrageous and Mr. Bickell needs to be fired immediately and brought up on criminal charges for obstruction of justice, and possibly treason."
26 November - And the Christian Science Monitor reports on the whole Cult of the COLB thing as well.
“Most of the world thinks this is settled except for a few conspiracy theorists,” says North Carolina Secretary of State Elaine Marshall. “In the 2000 election … Republican electors felt under siege, and I expect the Democrat electors may end up feeling the same way [this time].”
Wayne Abraham, a Democratic elector in Greensboro, N.C., says he’s received three letters – two signed, one not – and one phone call about Obama’s citizenship.
“I was surprised, but I’m not worried about it,” he says, dryly. “As I said to the lady on the phone, I figured that the Bush administration had ample opportunity to investigate Senator Obama, and if they had discovered he was not truly a citizen they … would have let us know.”
Towards the end, it says:
"Fueled by a historic presidential race that promised a dramatic shift in the direction of American power, the Obama citizenship flap, some experts say, shows that conspiracy theories still resonate with a subset of Americans. Over the years, the legitimacy of presidents from Thomas Jefferson to Abraham Lincoln has been questioned, though none about their citizenship status.
“Human beings will always go for myth because it’s compelling, dramatic, and, if it were true, it would be able to change history,” says Perry Leavell, a presidential historian and folklore expert at Drew University in Madison, N.J. “You can go back into the history of the American presidency and find over and over again people … who are prepared to believe the exact opposite of what all the data would say.”
26 November - and "Joe the Farmer" should be called "Joe the Propagandist", or maybe "Joe the Ignorant" or "Joe the Bald-Faced-Liar", as this article in the "American Thinker" shows. It's great in that it pretty much serves as a primer into what the Cult of the COLB believes, but is otherwise 105% fact free, treating any source that shows the cult is wrong with a contempt showing that whatever else "Joe the Stupid" is, he's proud of being pig-ignorant.
Otherwise, it's a rehash of the same tired old lies the cult of the COLB hangs on to desperately.
26 November - Justice Ginsberg denies the appeal of Cort Wrotnowski in the Connecticut case "Wrontnowski v. Bysiewicz".
This is the first time the Supreme Court has denied any of the Berg/Donofrio clone cases. Since Wrotnowski's case was assisted by Donofrio and made the same arguments about citizenship, it doesn't bode well for Donofrio's case.
Wrotnowski may try to get another Justice to look at it though, much like Donofrio did.
28 November - The "We The People Foundation" have decided to run their ad, (the one they planned for USA today but never got the money for), in the Chicago Tribune on 1 Dec. and 3 Dec.
And, laughably they're demanding that President-elect "direct the Hawaiian officials to provide access to his original birth certificate on December 5-7 by our team of forensic scientists, and to provide additional documentary evidence establishing his citizenship status prior to our Washington, D.C. press conference on December 8."
This is laughable for starters because they want THEIR "forensic scientists", (I assume that includes a Hawaiian junket for "Dr. Ron Polarik, FoS") to look at it. Yeah, right, have a team with a built-in bias look at it. That's gonna work, sure.
They also plan to have their shindig at the National Press Club on 8 December, and are hoping that C-SPAN covers it.
And lest you think they're not in it for the money....
"We are now in the process of selecting the forensic scientists who would travel to Hawaii to examine Mr. Obama’s original birth certificate (assuming he responds to the Petition for Redress by directing the Hawaiian officials to provide access to the birth certificate). The budget for this task is currently estimated at $20,000. We need to raise the money quickly. Unfortunately, we are starting from zero and we have but one week before the scientists would need to be in Hawaii."

They somehow seem to think that Obama seems to be controlling the judges dismissing this case, saying:
"You have repeatedly refused to provide evidence of your eligibility when challenged to do so in a number of recent lawsuits. Instead, you have been successful in having judges declare that they are powerless to order you to prove your eligibility to assume the Office of President."
Which is, like much of the ad, a total and complete lie.
They also demand the same things Berg demanded in his lawsuit, i.e.:
"• A certified copy of your original, signed “vault” birth certificate.
• Certified copies of your reissued and sealed birth certificates in the names Barack Hussein Obama, Barry Soetoro, Barry Obama, Barack Dunham and Barry Dunham.
• A certified copy of your Certification of Citizenship.
• A certified copy of your Oath of Allegiance taken upon age of maturity.
• Certified copies of your admission forms for Occidental College, Columbia University and Harvard Law School.
• Certified copies of any legal documents changing your name."
Again, the "Certification of Citizenship" and "Oath of Allegiance" demands are "gotcha" questions. There's no reason for a natural born citizen to have those, only a naturalized citizen. And naturalized citizens can't become president. If he doesn't have them, (a natural-born citizen wouldn't), they can claim he's not a citizen or never regained his citizenship. If he has them, he's automatically disqualified. Catch-22. The best thing for those questions is to ignore them.
It also makes clear their developing strategy of claiming he's an "usurper" and not a "bona fide" president as to try and undermine his presidency. And also makes this charming threat:
"All state Electors are now on Notice that unless you provide documentary evidence before December 15, that conclusively establishes your eligibility, they cannot cast a vote for you without committing treason to the Constitution."
Note - it's not treason to give in to wingbat demands that have not a single shred of evidence. The State of Hawaii has in fact confirmed his birth certificate, and there is no way in US law his mother marrying an Indonesian would have cost him his US citizenship.
It's starting to be obvious that all this is, is an attempt to try in the court of public opinion, the same claims being rejected by the courts. And it's also obvious no amount of proof will satisfy them. This is just an attempt by Berg's cultists to discredit the person who the majority of Americans have selected to be the next president.
Ultimately, I suspect it will make as much sense - and be treated pretty much like - another "Open Letter" to Barack Obama, this one demanding that president-elect Obama "make preparations to end the six-decade truth embargo regarding an extraterrestrial presence engaging the human race. "
Because that would be more believable than the Cult of the COLB "truthers"

Patrick -- You know and I know that Beg, Martin and Donofrio couldn't win an easement to plant shrubbery on a shared property line with the quality of "evidence" and "logic" contained in their filings. If the issue of "standing" hadn't created the proximate obstacle to proceeding, these cases would have been dismissed instantly and disciplinary action recommended for the filers. "Nuisance suit" doesn't begin to convey the amateurishness of their briefs.
The frequent invocation of The Constitution is merely an attempt to re-ennobilize a simmering gumbo of hate that's pretty much run out of cosmetically-attractive false-fronts. There's no more "For Hillary & Womankind" or "McCain/Palin: Country First" or "Fair Elections/Democracy Restored" to hoist up the flagpole anymore...and "Let's Get the Bastard!" just doesn't have that bunting-and-fireworks feel to it.
All we can do at this point is sit back and laugh, and hope that January 20th will see all this madness receding in the rear-view mirror.
In the meantime, kudos again for wading through tons of BS sites and comments, and packing the insanity into a handy, Cliff Notes summary. It's an unhappy task, but you do it with gusto.

Didn't you know that the WHOLE Supreme Court is in Obama's pocket? Yes, even Alito, Thomas, Scalia, Roberts & Kennedy. It was all a big conspiracy, orchestrated by Obama, starting when he was 23, to get his "conservative" useful idiots Reagan, Bush the Elder and Bush the Younger to nominate double-agent justices who claimed to be conservative so that in 2008, when Berg and other patriots brought these suits--and Obama in his insidious evil KNEW he they would bring the suits--they would vote to dismiss the suits. And the really clever thing is that everybody would THINK that they were conservatives and not double agent moles waiting in some cases for 20 years to dismiss the cases, and everybody would be fooled by Obama's nefariousness and evil, but not the PUMAs! They saw through this scheme, and if it weren't for them, we would believe that he was elected fairly.
So, in the name of all PUMAs, and in the name of all that is right and good, I ask you to bow down before Mr. Berg, et al., and recognize their wisdom and stop mocking them or believe me, they'll sue you, too.

My biggest fear is that some nut will take a shot at Obama and get lucky. With these PUMA asshole leaders stoking fear and anger among all the unstable nut, loser hangers-on, something bad could end up happening, and I'm glad you're holding them to account for their incitement.

I can't wait for Obama's inauguration, but to bad there will be no fireworks because Obama is to much of a good guy to waste money on fireworks, while Americans are suffering doing this time of economic trouble.

Patrick -- I agree that much of this is fueled by thinly veiled rascism, but another factor may also be at play: fear that Obama will be able to shape the future of the Supreme Court by his appointments, and thus the long-awaited dream of fundamentalists seeing Roe v. Wade overturned is slipping away. The inauguration will institute Obama in office, but I doubt the vexatious litigation will end. If it's not the COLB, it will be other issues. Alan Keyes has already announced that every action that Obama takes will be challenged in the courts.
We have to hope that at some point these folks just drain their pocketbooks and give up.

These noodlebrains already made clear where they're moving the goalposts after the COLB: he may have been born in the US, but he gave up his citizenship when he was a little boy and the all-powerful school registrar in Indonesia put down his nationality as Indonesian. How the little Indonesian got back into the U.S., stayed for decades, and evaded the INS while campaigning for state senator they don't say.
Wouldn't the state department have noted whether Obama had renounced his citizenship? They must keep records of former citizens, or else we could all waltz around the world collecting citizenships like girl scout badges.
Another gimmick to come will be faux-outrage at his having been a citizen all the time and not producing the long-form birth certificate and saving them all a lot of trouble and money.
To which I would say "It cost you time and money? Good." Moreover, this man has done nothing wrong and doesn't have to oblige the hostile goons persecuting him.
Nowhere on any PUMA blog--not that I'd expect it--does anyone consider the implications of their own behavior, if Obama is a genuine Hawaii-born citizen. Why have they asked him to do more than any other candidate for president has had to do? Why is he of all people constantly being asked for his papers?

Pat - Because it wouldn't solve it. If he presented an authentic "Vault Copy", certified by the State of Hawaii, an angelic choir, and God himself, within 24 hours the cultists would have it "debunked", "Polarik" will have a long rambling "analysis", and others will simply say it doesn't matter because he lost his citizenship in Indonesia / he's not "natural born" / fill in the blank.
